These Terms of Service ("Terms") govern your use of this website (the "Site") and the services offered by RosaVita Wellness ("we," "our," "us"). By using the Site or requesting services, you agree to these Terms. If you do not agree, please do not use the Site or request services.
1. Services
We provide therapeutic and relaxation massage services in the State of Florida. Services are performed by a Florida-licensed massage therapist. Our license number is displayed on the Site footer and is also available on request from the Florida Department of Health, Board of Massage Therapy.
2. Booking and Confirmation
Submitting a booking request through the Site is a request only — your appointment is not confirmed until you receive an explicit confirmation from us by email or phone. We reserve the right to decline or reschedule any request at our sole discretion.
3. Cancellation and No-Show Policy
48-hour notice required. Cancellations or rescheduling requests must be made at least 48 hours before the scheduled appointment time.
- Cancellations or reschedule requests made less than 48 hours before the appointment, and no-shows, may be charged the full service fee.
- Any unpaid late-cancellation or no-show fee must be settled before a future booking can be confirmed.
- Late arrivals shorten your session; the full session length cannot be guaranteed and the full service fee still applies.
4. Health and Medical Disclaimer
The services we provide are wellness and relaxation services. They are not a substitute for diagnosis, treatment, or advice from a licensed medical professional. If you have a medical condition or injury, are pregnant, are taking medication, or have any health concerns, you must consult a licensed physician before scheduling a session.
You agree to truthfully disclose all health information that may affect treatment on our intake form and verbally before the session begins. Failure to disclose relevant health information releases us from liability for any resulting injury or condition.
5. Right to Refuse Service
We may decline, terminate, or modify service at our discretion for any lawful reason, including but not limited to: inappropriate behavior or language; arrival more than 30 minutes late; signs of intoxication; or any conduct that creates an unsafe or unprofessional environment.
6. Payment
Accepted payment methods, deposit requirements, and amounts due are as posted on the Site or communicated at the time of booking. All fees are payable in U.S. dollars. Returned or disputed payments may incur additional fees as permitted by Florida law.
7. Limitation of Liability
To the maximum extent permitted by Florida law, our total liability arising out of or relating to these Terms or your use of the services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnification
You agree to indemnify and hold harmless RosaVita Wellness, its owner, and its representatives from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misrepresentation or non-disclosure of health information, or (c) your conduct before, during, or after a session.
9. Intellectual Property
All content on the Site — including text, images, logos, and visual design — is the property of RosaVita Wellness or its licensors and is protected by copyright and trademark law. You may not reproduce, modify, or distribute Site content without our prior written permission.
10. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any action arising out of or relating to these Terms or your use of the Site or services shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may modify these Terms at any time by posting the revised version on the Site. The "Last updated" date will reflect the change. Your continued use of the Site or services after changes are posted constitutes acceptance of the revised Terms.
12. Severability
If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
